Terms of Service

These terms govern your use of this website and any purchase you make from Keratresse. By browsing the site or placing an order, you agree to them. We have written them in plain language wherever the law allows. If anything here is unclear, ask us and we will explain it.

1. Agreement to these terms

These Terms of Service form a binding agreement between you and Keratresse. They apply alongside our Privacy Policy and our Shipping & Returns Policy, both of which are incorporated here by reference. If you do not agree to these terms, do not use the site or order from us.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that you meet this requirement and that the payment method you use belongs to you or that you have permission to use it.

3. Accounts

You may check out as a guest or create an account. If you create one, keep your password confidential and tell us promptly if you suspect unauthorized access. You are responsible for activity that occurs under your account. Provide accurate information and keep it current — a stale shipping address is the single most common cause of an order going astray. We may suspend or close accounts used for fraud, abuse or repeated chargebacks.

4. Orders and acceptance

Placing an order is an offer to buy. Your order is accepted when we send a shipping confirmation, not when the site displays an order confirmation or when your card is authorized. Until then we may decline or cancel an order, in whole or in part, including where:

• the item is out of stock or a batch fails our quality checks;
• a price, description or promotion was published in error;
• we cannot verify the payment method or billing details, or the order is flagged as fraudulent;
• the order appears to be for resale rather than personal use;
• we cannot lawfully ship the item to your address.

If we cancel an order after taking payment, we refund the amount charged in full to the original payment method.

5. Pricing, payment and tax

Prices are listed in US dollars and may change without notice. The price that applies to your order is the price displayed at the moment you complete checkout. Shipping charges and applicable sales tax are calculated at checkout and shown before you pay.

We accept the payment methods displayed at checkout. You authorize us and our payment processor to charge the full order total, including shipping and tax, to the method you provide. If a pricing error is obvious — a product listed at a small fraction of its normal price, for example — we may cancel the order and refund you rather than honour it.

International customers are responsible for any customs duties, import taxes and brokerage fees charged on arrival. These are not included in our prices and we cannot estimate them for you.

6. Promotions and discount codes

Unless a promotion says otherwise: one discount code per order; codes cannot be combined; codes have no cash value and cannot be redeemed for cash; codes apply to product subtotal only, not shipping or tax; and codes cannot be applied retroactively to an order already placed. We may end or modify a promotion at any time, and we may void orders where a code has been obtained or used in a way it was not intended.

7. Shipping and delivery

Processing times, carriers, rates and delivery expectations are set out in our Shipping & Returns Policy. Delivery dates are estimates and are not guaranteed. Title and risk of loss pass to you when the carrier takes possession of the parcel, though we will still help you pursue a claim for a package lost in transit as described in that policy.

Some styling products, including aerosols and any product with a flammable propellant or a high alcohol content, are regulated as limited-quantity dangerous goods for shipping. Where an item in your order is affected, this restricts which services we can use and may make certain destinations, military addresses and expedited air services unavailable. Checkout will show the options available for your address.

8. Returns and refunds

Unopened, unused products in their original packaging may be returned within the window set out in our Shipping & Returns Policy. For hygiene and safety reasons, products that have been opened or used cannot be returned or resold and are final sale, except where they arrive damaged, incorrect or defective — in which case we will make it right. The full terms, including the reporting window and who pays return postage, are in that policy.

9. Product descriptions and images

We describe our products as accurately as we can, but results vary from person to person. Hair type, porosity, density, condition, water hardness, previous chemical services, how much product you use and how you style all change the outcome. Descriptions of benefits such as smoothness, volume, moisture, hold or tone describe what a formula is designed to do; they are not guarantees of a particular result on a particular head of hair.

Toning products deserve a specific note. The tonal change a purple or pigmented product produces depends heavily on your starting level, how porous your hair is, how long the product is left on and how often it is used. Uneven, previously coloured or chemically treated hair can take pigment unevenly. We cannot guarantee a specific shade result, and these products are not a substitute for professional colour correction.

Minor variation between manufacturing batches in colour, viscosity or scent is normal and does not affect performance. Product photography is representative; screen colour rendering varies, and bottle, cap and label details may change between production runs.

10. Safe use of our products

• Patch test. Apply a small amount to the inside of your forearm or behind the ear and wait 24 hours before using a product for the first time. Discontinue use if irritation, redness or itching develops.
• Avoid eyes. These products are not formulated as tear-free. If product enters the eyes, rinse thoroughly with water and keep rinsing until the irritation stops. Seek medical advice if it persists.
• Do not apply to broken or irritated skin. Do not use on a scalp that is cut, sunburned, abraded or affected by an active skin condition.
• Observe leave-on times. Treatments, masks and toning products state a time on the label. Leaving a product on longer does not improve the result and can cause over-conditioning, dryness or, with pigmented products, unwanted tonal deposit.
• Pigmented and toning products stain. Purple and other pigmented formulas can stain skin, nails, towels, clothing, grout and porous surfaces. Wear gloves if you are sensitive to staining, rinse spills promptly, and keep them away from light-coloured fabric and stone.
• Wet surfaces are slippery. Conditioners, oils and masks make tubs and shower floors slippery. Rinse the surface after use.
• Heat styling. Unless a product is labelled as heat protective, do not assume it protects hair from thermal styling. Let aerosol or alcohol-containing products dry fully before using a heat tool.
• Keep away from flame and heat. Aerosols and alcohol-containing products are flammable. Do not puncture or incinerate aerosol cans, and do not store product in a hot car or in direct sunlight.
• Keep out of reach of children and pets. These are not animal grooming products and should not be used on pets.
• Pregnancy and medical conditions. If you are pregnant, nursing, or have a scalp, skin or respiratory condition, consult a healthcare professional before use.
• Chemically treated hair. If your hair has been recently coloured, relaxed, permed, bleached or keratin-treated, check with your stylist before introducing a new product. Clarifying and high-pH products in particular can affect the longevity of a chemical service.

Our products are cosmetics, not drugs. Nothing on this site is a medical claim. They are not intended to diagnose, treat, cure or prevent any condition — including hair loss, thinning, dandruff, psoriasis or any scalp disorder — and no statement about condition, strength, growth or appearance should be read as one. If you experience a serious reaction, stop using the product and seek medical advice.

11. Ingredients, testing and compliance

Our products are cosmetics under the US Federal Food, Drug, and Cosmetic Act, and are formulated, labelled and listed in accordance with applicable cosmetic regulation, including the Modernization of Cosmetics Regulation Act. Full ingredient declarations are provided on product packaging in the form required by the market in which the product is sold, and we publish ingredient information on the product pages of this site. If you need to know whether a specific material appears in a specific product before you buy, ask us and we will tell you.

You are responsible for checking product information against your own known allergies and sensitivities.

12. Subscriptions and recurring orders

Where a product offers a subscription option, you are authorizing a recurring charge at the interval you select, continuing until you cancel. The discount shown applies to each recurring order for as long as the subscription is active.

Prices, availability and the discount applied may change, and we will give you notice before a change takes effect on a future order. We charge and ship at the interval you chose using the payment method and address on file, so please keep both current — a failed payment or an undeliverable address will pause or cancel the subscription.

You may cancel or change the interval at any time from your account or by contacting us, effective for orders not yet processed. An order already processed or handed to the carrier cannot be cancelled and is subject to the Shipping & Returns Policy like any other order.

13. Reviews and content you submit

We publish reviews from verified orders and we do not edit them to be nicer. When you submit a review, comment, photo or other content, you grant Keratresse a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, display and distribute that content in connection with our business, including in marketing, with attribution to the display name you provide.

You confirm that the content is your own, that it reflects your genuine experience, and that it does not infringe anyone's rights. We may decline to publish or may remove content that is unlawful, defamatory, harassing, obscene, contains personal information about someone else, is spam or advertising, or is submitted by someone who did not buy the product. Removing a review is not something we do because it is negative.

14. Intellectual property

The site and its contents — including text, product copy, photography, illustration, layout, brand names, product names, logos and taglines — are owned by Keratresse or its licensors and are protected by copyright, trademark and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, republish, scrape, sell or use our content or branding for commercial purposes, or use it in a way that suggests we endorse or are affiliated with you, without our written permission.

Our formulations are our own. Where another brand or product is referenced for comparison, that reference is descriptive only and claims no affiliation with, sponsorship by or endorsement from that brand.

15. Acceptable use

You agree not to:

• use the site for any unlawful purpose or in breach of any applicable law;
• attempt to gain unauthorized access to the site, its servers, or any account that is not yours;
• introduce malware, or interfere with the site's operation or security;
• scrape, harvest or systematically extract data, product listings or customer reviews, whether by automated means or otherwise;
• use automated tools to bulk-purchase limited releases or circumvent purchase limits;
• resell our products as a distributor or retailer without our written agreement, or misrepresent our products as your own;
• submit false information, fraudulent payment details, or reviews you did not write.

We may suspend or terminate your access to the site at any time for breach of these terms.

16. Third-party links and services

The site links to and relies on third-party services, including payment processors, shipping carriers and social media platforms. We do not control those services and are not responsible for their content, terms or availability. Your dealings with them are governed by their own agreements.

17. Affiliate program

Participation in our affiliate program is subject to the separate program terms provided when you join. Affiliates must disclose their relationship with us clearly wherever required by law, including under the US Federal Trade Commission's endorsement guidelines, and may not bid on our brand terms in paid search, use spam or unsolicited email, or make claims about our products that we have not made ourselves.

18. Disclaimer of warranties

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components, or that any defect will be corrected.

Nothing in these terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded, including rights you may have as a consumer under the laws of your jurisdiction.

19. Limitation of liability

To the fullest extent permitted by law, Keratresse and its owners, employees and suppliers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to your use of the site or our products, whether based in contract, tort, strict liability or otherwise, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim relating to an order will not exceed the amount you paid for that order.

These limits do not apply to liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or to any other liability that cannot be limited under applicable law. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you.

20. Indemnification

You agree to indemnify and hold harmless Keratresse and its owners and employees from any claim, loss, liability or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the site, or content you submit.

21. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the jurisdiction of those courts. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer provisions of your local law.

Before filing anything, please contact us. Most problems we have ever had with an order were solved by an email.

22. General provisions

• Severability. If any provision is found unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition or sale of assets.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including carrier disruption, supply shortages, natural disasters and government action.
• Entire agreement. These terms, together with the Privacy Policy and Shipping & Returns Policy, are the entire agreement between us regarding the site and your purchases.

23. Changes to these terms

We may update these terms at any time. The current version is always posted on this page with a revised "last updated" date. Changes apply to orders placed after they are posted; the terms in effect when you ordered govern that order. Continued use of the site after an update means you accept the revised terms.
